1. Who we are

These Terms of Use (the "Terms") are an agreement between you and Commercium Limited ("we", "us"), a company registered in England and Wales under company number 16456125, at 14/2e Docklands Business Centre, 10-16 Tiller Road, London E14 8PX, United Kingdom. They cover the mobile game Three Seals: Dojo Duel (the "App") and this website, threeseal.com (together, the "Services"). By installing or using the App, or using this website, you accept these Terms. If you do not accept them, please do not use the Services.

2. The game

Three Seals: Dojo Duel is a card game in which you duel computer-controlled masters. It can be played without an internet connection. Online duels against other players are not available yet; if we add them, any extra rules that apply to them will be shown before you can take part.

3. Age and families

The App is designed to be suitable for players of all ages. If you are under the age of majority where you live, please read these Terms with a parent or guardian, who accepts them on your behalf.

4. Price and purchases

The App is free to download and play and does not currently offer in-app purchases. If we introduce optional purchases in a future version, they will be sold through the App Store under Apple's terms, prices will be shown in the App before you buy, and refunds will be handled by Apple under its policies. Your statutory rights are not affected.

5. Your progress

• Your fighter, name, belt, points, wins and collections are stored on your device and, if iCloud is turned on, in your own iCloud storage.
• Progress, belts, seals, stamps and any other in-game items have no monetary value. They cannot be exchanged for money, sold, transferred or traded.
• You can erase your progress at any time with Menu › Delete my data. Deleted progress cannot be recovered.
• We cannot restore progress that was lost because a device was reset, iCloud was turned off, or the App was deleted without an iCloud copy.

6. Game Center and iCloud

Leaderboards and achievements use Apple Game Center and are provided by Apple under Apple's own terms and privacy policy. Your Game Center nickname and scores may be visible to other players as set by Apple. iCloud storage is likewise provided by Apple.

7. Fair play

You agree not to:

• cheat, use bots, or manipulate scores, leaderboards or achievements;
• copy, modify, decompile, reverse engineer or create derivative works from the App, except where the law expressly allows it;
• interfere with or attempt to gain unauthorised access to the Services or the systems behind them;
• scrape or copy this website in bulk, or use the Services for anything unlawful.

If you break these rules we may, where the law allows, remove scores or restrict your use of features that we control.

8. Intellectual property

The App and this website, including the name Three Seals, the characters (among them Peanut, Tosby and Huma), artwork, animation, card designs, text, music and code, belong to Commercium Limited or are used under licence. Some sound effects come from public-domain (CC0) libraries. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, for your own non-commercial entertainment, in line with these Terms and the App Store rules. Nothing in these Terms transfers ownership of anything to you.

9. Apple and the App Store

The App is distributed through the Apple App Store. Unless we provide a separate licence in the App Store listing, Apple's standard Licensed Application End User License Agreement also applies, and these Terms add to it. These Terms are between you and Commercium Limited only, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law Apple has no other warranty obligation for the App. Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, consumer protection claims, or claims that the App infringes a third party's intellectual property rights; we are responsible for handling such claims to the extent these Terms and the law require. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.

10. Availability and changes

We work to keep the Services running and enjoyable, but they are provided "as is" and "as available". We may update the App, change or remove features, adjust game balance, or stop offering the App or this website. We do not promise that the Services will be uninterrupted or free of errors.

11. Liability

To the fullest extent the law allows, we are not liable for any indirect or consequential loss, loss of data or progress, or loss that was not reasonably foreseeable, arising from your use of the Services. Because the App is provided free of charge, our total liability to you for any claim relating to the Services is limited to £50. Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or for fraud, and nothing affects your statutory rights as a consumer.

How we handle information is explained in our Privacy Policy. This website's use of cookies (none) is explained in our Cookie Policy.

13. Changes to these terms

We may update these Terms when the App or the law changes. The date at the top of this page shows the latest version. If a change is significant, we will also let you know in the App. Continuing to use the Services after an update means you accept the updated Terms.

14. Law and contact

These Terms are governed by the laws of England and Wales. You and we both submit to the non-exclusive jurisdiction of the courts of England and Wales; if you live elsewhere in the UK or in the European Union, you may also bring proceedings in the courts where you live, and you keep the protection of the mandatory laws of your country.
